Not registered user watching registered user profile field setted as "private", he can see it anyway. Also if not registered watch an Admin profile with a field setted as "private".
Moderators and self are exempt from privacy. If a user sets a field to private then the moderator can still see it as well as the user that owns the profile. Ensure CB Privacy within CB > Plugin Management is Public access otherwise it will not run for public users causing privacy to not work for public viewing. Edit the users field privacy within backend to ensure it's configured correctly.

Plugin is public. I login with a registered user, set telephone field as "private". Then I check in backend and it correctly says that is "private". Now I open another browser and as NOT LOGGED IN visit that user profile and I can see the telephone number.
What type of field is your telephone field? CB has no such fieldtype. Does it work with any other fields?
