I am trying to create a popup with autoactions after login which will check if a user has accepted the terms and conditions (as they register through facebook).
If they have accepted then the popup will not show, however if they have not accepted then they must check the accept button before proceeding to the site.
Any one have any idea how I can implement this?

It can't because the login progress has no output. Your popup needs to be done at the landing page after login.

Terms and conditions for CB Connect usages should be handled in your provider application it self. For Facebook you'd edit your application then click Settings > Basic then set your URL in "Terms of Service URL".
