While doing this testing I came across the fact that the user gets access to the restricted material when he has ordered but not paid for the subscription. Is there a setting to prevent this, until paid?

Possibly, disable Gantry then switch to default Joomla template and see if issues persists.

Yes, edit your offline gateway and set it to require payment before becoming active
