The reason there is an alert is the validation is done after the POST. You can't properly validate the upload until the upload has been made. The reason the "accept" attribute is not used is because until recently it barely worked. For example it only works on IE10 and no previous versions of IE recognize it, but is something we could add to CB 2.0; for now we can't implement this because all previous versions of IE won't validate the HTML.
