Ok, so in the incident that the user is not logged in, ie. Public, then there is no user object, and then there is no CBUser, correct?

Yes, that's correct. If you're using CBuser::getInstance( USER_ID ) you need to call it as CBuser::getInstance( USER_ID, false ) so it can't return null. Otherwise if the user is guest it'll return null.
